Terms of Service

What this website is, what sending an enquiry does and does not commit you to, and the law that applies.

The short version

This website describes what we do. Reading it or sending an enquiry does not sign you up to anything and does not cost you anything. Paid work starts only when we have both agreed what it is, in writing, and you have said yes.

Who you are dealing with

This site is operated by HagoDigital, a digital marketing business run by Juan Pablo Tagliaferro from Sydney, New South Wales, Australia. Contact: jp@hagodigital.ai.

Using this site

You are welcome to read it, quote it and link to it. Please do not copy it wholesale to build something that passes as ours, try to break into it, or use the enquiry form to send anything unlawful or abusive.

An enquiry is not a contract

Nothing on this website is an offer capable of being accepted. There are no prices here, and there is no automatic booking — sending the form or messaging us starts a conversation, nothing more. Either of us can end that conversation at any point, for any reason, without owing the other anything.

If we go ahead, the work is set out in a separate written agreement that covers scope, price, payment and what happens if either side wants to stop. That agreement governs the work, not this page, and if the two ever disagree, the agreement wins.

Quotes

Every quote is prepared for one business and one piece of work, is given in writing, and says how long it stands for. A quote is not a fixed price for anyone else, and it does not carry over to a different job.

Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, services must be provided with due care and skill, be fit for any purpose we have agreed, and be delivered within a reasonable time. Nothing on this page or in any agreement we sign takes those rights away, and any term that tried to would have no effect.

What we do not promise

We will not promise you a search ranking, a number of enquiries, a sales figure, or a date on which Google will verify a business profile — because none of those are ours to give. Anything we do say about results describes what the work is designed to do, not a guaranteed outcome.

We also do not promise this website will be available without interruption. It is hosted by a third party and can go down.

Who owns what

The text, design, code, illustrations and logo on this site belong to us, except where they belong to someone else and are used with permission.

Work we produce for a client is a different matter, and the answer is the one we say out loud everywhere else on this site: when a job is finished and paid for, the files are yours. The written agreement for that job sets out exactly what transfers and when.

Links to other places

Where we link to WhatsApp, Google or anyone else, you leave this site and their terms apply. We do not control those services and are not responsible for them.

Accuracy

We keep this site current and correct to the best of our ability, and any illustration or example is there to explain an idea rather than to describe a specific result someone got.

Liability

To the extent the law allows, and always subject to your Australian Consumer Law rights above, we are not liable for loss arising from your use of this website — for example, from acting on general information here without getting advice about your own situation. Where liability cannot be excluded, it is limited to supplying the service again or paying the cost of having it supplied again.

The law that applies

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.

Changes to these terms

If these terms change, the new version appears on this page with a new date at the top. The version in force when you sent an enquiry is the one that applied to it.
